PREAMBLE
Mag. Claudia Gföller offers a 12-week course program MENO MAGIC on the online platform MENO Academy, including the following content: presentations, videos, audios, image files, live calls, specialist lectures, group and individual calls.


GENERAL
The following general terms and conditions apply to the implementation of the MENO MAGIC course program. These terms and conditions are deemed to be legally binding and accepted by the course participant or purchaser upon registration at the latest. Amendments to these general terms and conditions are generally excluded and, in the case of deviating special agreements, are only effective if agreed upon in writing. Any such amendments to the terms and conditions are only valid for the respective legal transaction and expressly not for follow-up transactions or new registrations after the termination of a service.


DEFINITIONS
A participant is defined as anyone who registers for a course program, an information session, an e-exercise and training unit, individual and group instruction, a workshop, or lectures and/or purchases a package. Registration is the verbal or written declaration of intent to take advantage of an offer from MENO Academy, Claudia Gföller (Mag.). The MENO MAGIC course program generally lasts 12 weeks. A unit for course programs, information sessions, exercise and training units, individual and group instruction, workshops, and lectures lasts from 1 hour up to a multiple thereof. A course is a training offering consisting of multiple units. A workshop and a seminar are events that last longer than 1.5 hours.


REGISTRATIONS – VALIDITY OF THE GENERAL TERMS AND CONDITIONS – DATA PROTECTION
Registrations for booked events are binding. By registering, the participant accepts these general terms and conditions without reservation. Personal data will be processed and stored in accordance with applicable legal regulations. Information received from participants in the course of providing the services offered will be treated confidentially.


TEACHING OFFERINGS
If a course requires special personal requirements, these must be met by the participant. If a course requires a minimum number of participants, MENO Academy, Mag. Claudia Gföller, reserves the right to cancel the course due to insufficient registrations. Payments made will be refunded immediately. Any changes to the course schedule will be announced in a timely manner. Relevant information will be available at

HEALTH FITNESS – PREGNANCY – ILLNESSES
Participation in course programs, information sessions, exercise and training sessions, individual and group lessons, workshops, and lectures requires the participant to be healthy. Therefore, anyone feeling ill should not participate. Anyone suffering from a communicable disease is not permitted to attend in-person events.


MENO Academy, Claudia Gföller reserves the right to refuse participation if there are any doubts about a participant's health suitability. Pregnancy, joint or spinal injuries, heart problems, and other physical impairments must be reported prior to the start of the course. Should a participant have any doubts about their health or mental suitability to participate, they are advised to seek appropriate professional/medical advice before registering.

MENO Academy, Claudia Gföller, reserves the right to reject participants if it is deemed that the health or psychological requirements for participation are not met. This rejection may occur at short notice or even during ongoing sessions. In the event of a rejection, the course fee will be refunded (pro rata).


PAYMENT TERMS
Current costs for information sessions, training units, courses, private lessons, workshops, and lectures will be provided in writing upon request. MENO Academy, Mag. Claudia Gföller, is entitled to payment of the participation fee upon legally binding registration and confirmation of participation. Registration is legally binding upon submission of the registration by email, post, or booking via the website. Telephone registrations are confirmed by email; registrations are legally binding upon receipt of the confirmation email from the participant. When registering for individual units, the participation fee must be paid before the start of the course. When registering for courses or workshops, the participation fee must be paid no later than three days before the start of the course or workshop. If the participation fee is not paid by this date, MENO Academy, Mag. Claudia Gföller, is entitled to either adhere to the contract and continue to demand the agreed participation fee or to withdraw from the contract and award the place to another person.

Cancellations must be made in writing or by email. If you cancel your registration for courses, lectures, or workshops up to 10 days before the start of the event, no cancellation fee will be charged. If you cancel up to 3 days before the start of a course program, exercise and training sessions, individual and group lessons, workshops, or lectures, a cancellation fee of 50% of the fee will be charged. If you cancel after the course has begun, fail to attend without notifying us ("no show"), or fail to attend an in-person event due to an individual official order (e.g., under the COVID-19 Measures Act), the full course fee will be charged.


If course programs, information sessions, practice and training sessions, individual and group lessons, workshops, and lectures are canceled 12 hours before the agreed date, the full amount is due. Should courses that have already begun not be able to be completed on-site due to COVID-19 regulations or other legal requirements, the remaining sessions will be offered online as an alternative. This does not entitle you to a refund – even a partial refund – of any course fees already paid.


DATES
The implementation of the MENO Magic course program as well as other courses, training units, lectures, webinars, seminars will take place at the times stated on the website
www.menoacademy.com Classes will take place at the dates and times advertised in brochures and flyers. MENO Academy, Claudia Gföller, reserves the right to change the stated dates and program/schedule in the event of unavoidable circumstances (e.g., illness) or if the course cannot be held at the planned location. No classes will be held on public holidays. All class breaks will be announced in advance via publication at www.menoacademy.com.


Participants will be informed in a timely manner of cancellations and an alternative date will be arranged. If no alternative date can be found, the already paid participation fee will be refunded.
If individual appointments for private lessons are cancelled, alternative appointments will be arranged separately.


LIABILITY
MENO Academy, Mag. Claudia Gföller, assumes liability for the proper conduct of the course programs, information sessions, exercise and training units, individual and group lessons, workshops, and lectures within the framework of the statutory warranty provisions. Any further liability, particularly under the title of compensation, is excluded. Liability for clothing, valuables, or money is excluded. Participation in the courses is at the participants' own risk. Exercises and postures during the lessons are to be carried out by the participants themselves. MENO Academy, Mag. Claudia Gföller, assumes no liability whatsoever, in particular no liability whatsoever in the event of the concealment of any physical or mental ailments that make participation in the course programs, information sessions, exercise and training units, individual and group lessons, workshops, and lectures inadvisable, particularly for medical, physical, or psychological reasons.


FINAL PROVISIONS
The place of performance of all obligations is the registered office of MENO Academy, Mag. Claudia Gföller, Wasserweg 5a, 6413 Wildermieming. Austrian law applies. The place of jurisdiction for all legal disputes is the
The competent courts for the place of performance shall have exclusive jurisdiction. Should individual provisions of these General Terms and Conditions, as well as any individual contracts to be concluded, be or become void, ineffective, or contestable, the remaining (partial) provisions shall remain unaffected and shall then be interpreted or supplemented in such a way that the intended economic purpose is achieved as closely as possible.
